The scheme significantly reduces the rate of damages for eligible historical defaults and provides an opportunity to settle long-pending disputes at considerably lower cost.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">1. Introduction<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">EPFO has introduced <strong>VISHWAS, 2026<\/strong> with the objective of facilitating <strong>amicable settlement of disputes relating to damages for delayed remittance of Provident Fund contributions<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The scheme offers a <strong>substantial reduction in damages<\/strong> for eligible cases relating to defaults <strong>prior to 14 June 2024<\/strong>, thereby enabling employers to resolve pending proceedings and litigation with significant financial savings.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">2. Background<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Historically, damages under <strong>Para 32A of the Employees&#8217; Provident Fund Scheme, 1952<\/strong> were levied at comparatively higher rates depending upon the period of delay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">With the notification of the <strong>EPF Scheme, 2026<\/strong>, EPFO has simultaneously introduced <strong>VISHWAS, 2026<\/strong>, which prescribes <strong>concessional rates of damages<\/strong> for eligible historical defaults.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For establishments having pending 14B proceedings, appeals or unpaid damage orders, this presents an excellent opportunity to settle disputes at nearly <strong>half the earlier rate<\/strong> in long-delay cases.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">3. Scheme Period<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Scheme commencement:<\/strong> <strong>29 June 2026<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Validity:<\/strong> <strong>Six months from the date of notification<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Accordingly, employers may apply under the scheme <strong>up to 28 December 2026<\/strong> (subject to any extension by EPFO).<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">4. Benefit Available For<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The reduced rates under VISHWAS apply <strong>only to damages relating to periods of default prior to 14 June 2024<\/strong>, irrespective of when the proceedings are concluded, provided the case satisfies the eligibility conditions prescribed under the scheme.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">5. Who Can Avail the Scheme?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The scheme covers the following categories of establishments:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A. Pending Litigation<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where damages under Section 14B\/Section 128 are under challenge before any judicial forum.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">B. Final Orders where Damages remain Unpaid<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Recovery Certificate (RRC) cases<\/li>\n\n\n\n<li>Partially paid cases<\/li>\n\n\n\n<li>Completely unpaid damage orders<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">C. Notice Issued but Final Order Pending<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Where proceedings have commenced but the final damages order has not yet been passed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">D. Cases where Notice is yet to be issued<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Even if proceedings have not commenced, eligible historical defaults may still be covered.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">7. Important Conditions<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Employers should note the following conditions before applying:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Entire <strong>interest under Section 7Q (or Section 127 of the Code)<\/strong> must be <strong>fully paid<\/strong> before submitting the application.<\/li>\n\n\n\n<li>Employer must furnish an undertaking that <strong>no further appeal<\/strong> shall be pursued after settlement under VISHWAS.<\/li>\n\n\n\n<li>Applications are to be submitted <strong>online<\/strong> through the EPFO employer portal.<\/li>\n\n\n\n<li>The application must be authenticated using <strong>Digital Signature Certificate (DSC) or e-Sign<\/strong>.<\/li>\n\n\n\n<li>Upon approval, the revised damages are required to be paid within the stipulated timeline specified by EPFO.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">8. Cases Not Eligible<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The following cases have specifically been excluded:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Damages already fully recovered.<\/li>\n\n\n\n<li>Cases involving fraud, misappropriation or deliberate falsification of records.<\/li>\n\n\n\n<li>Cases where the applicable interest has not been fully remitted.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p class=\"wp-block-paragraph\">9.
